PREAMBLE

The websites https://www.ski-mojo.com/, https://www.ski-mojo.fr/ and https://www.ski-mojo.ski/ (hereinafter the “Site” or the “Sites”) are e-commerce websites offering goods/services for sale to internet users browsing any of these Sites.

The Buyer (hereinafter the “Buyer”) means any person visiting one or more webpages of the Sites, whether or not they have initiated a purchase process on any of the Sites.

The Seller (hereinafter the “Seller”) is MOJO TECHNOLOGIES SAS (formerly JAKSPORTS SAS) with share capital of €400,000.00, registered office at 25 rue de la Saulne, Les Dolynes, 74230 Thônes, France, registered with the Annecy Trade and Companies Register under SIREN 807 972 732 and EU VAT number FR49807972732, hereinafter “MOJO TECHNOLOGIES”.

These terms of sale (hereinafter the “Terms & Conditions of Sale” or “T&Cs”) govern, without restriction or reservation, all relations between the Seller and any person purchasing products/services provided by the Seller on the Sites.


 

ARTICLE 1: PURPOSE AND SCOPE

These T&Cs define the terms of sale between the Seller and the Buyer. They apply to all sales of products or services offered on the Sites, whether the order was placed by phone, fax, postal mail, email or via the internet.

Any order on the Sites necessarily implies that the Buyer has read these T&Cs prior to ordering and accepts them in full. Acceptance of these T&Cs takes effect when you validate your order.

The applicable T&Cs are those in force on the date the Buyer validates the order. The Seller reserves the right to modify the T&Cs at any time without notice; any changes will apply to orders placed after such modification.


ARTICLE 2: MOJO TECHNOLOGIES’ OFFER

2-1 – Geographic coverage
Products presented for online sale on the Sites are delivered to most countries. The geographic coverage for each sale may vary depending on distribution agreements with our referenced suppliers and the delivery methods. The Seller may use “country filters” on the Site to block orders originating from countries not covered by the offer. In Europe, destinations requiring special customs formalities are excluded, such as Büsingen, Heligoland, Jersey, Guernsey, the Isle of Man, the territories of Campione d’Italia and Livigno, the Canary Islands, Ceuta, Melilla, the Faroe Islands, Greenland, Åland, Mount Athos, and the northern part of Cyprus.

2-2 – Stock and availability
A product listed as “in stock” is physically present in the Seller’s own inventory. Actual availability may change quickly depending on sales on the Site or supplier stock levels (some items are restocked on a just-in-time basis). A product marked “available within x days” means our supplier will resupply us within that number of business days, subject to supplier availability. Errors or changes may exceptionally occur. A product marked “available on DD/MM/YY” means we expect to receive the product in our warehouse on that date; it is not the date of delivery to the Buyer’s address. The Seller cannot be held liable if indicative availability or delivery times change. If a product becomes unavailable after ordering, the Seller undertakes to contact the Buyer as soon as possible by phone or email. The Buyer may choose to keep or cancel the order. The Seller will refund by crediting the bank account no later than fourteen (14) days from the Buyer’s payment.

2-3 – Product characteristics

Products offered for sale are described and presented as accurately as possible. However, if errors or omissions occur, the Seller’s liability cannot be engaged. Photos are non-contractual.

For Ski~Mojo Gold, Ski~Mojo Silver and Ski~Mojo Blue items, the Buyer undertakes to read the User Manual before any use. The manual contains important setup and safety information. A digital copy is available at www.ski-mojo.com/help.

2-4 – Prices

Our product prices are shown in euros, including French taxes, and are firm and final. They exclude shipping and any other order processing fees charged in addition and shown before the Buyer validates the order.

The Seller reserves the right to change prices at any time without notice. Products will be invoiced to the Buyer based on the rates recorded at the time the order is validated. We regularly perform maintenance on our site, which may cause pricing errors. In such cases, the order cannot be fulfilled and we will contact you to cancel and fully refund your order as soon as possible.

Products remain the property of the Seller until paid in full.

2-5 – Export orders and customs duties

Any order shipped outside the European Union and French overseas departments and territories (DOM-TOM) will automatically be invoiced exclusive of tax.

Import formalities, customs duties and any taxes related to delivery outside the EU and in the DOM-TOM are borne solely by the Buyer. They must be paid to the competent authorities in the destination country. The Buyer is solely responsible for verifying the importability of the ordered products under the laws of the destination country. The Seller is not required to verify or inform the Buyer of applicable customs duties and taxes. To obtain this information, the Seller advises the Buyer to contact the relevant local authorities. By ordering on the Site, you are deemed the official importer and must comply with all laws and regulations of the country where you receive the goods. Cross-border deliveries may be subject to inspection by customs authorities.


ARTICLE 3: ORDERING PROCESS AND TERMS

3-1 – Eligibility to order
The Buyer must have legal capacity or parental authorization to place an order on the Site.

3-2 – Order steps
  • Select items and add to cart;
  • Validate cart contents;
  • Log in to the Site if not already logged in;
  • Select a delivery method;
  • Select a payment method and accept the T&Cs;
  • Validate payment;
  • Dispatch of goods.


The Buyer can place an order online via the Site. The data provided by the Buyer and recorded by the Seller at the time of ordering constitute proof of transactions between the parties. Clicking to validate after completing the order form constitutes order confirmation and an electronic signature with the same legal value as a handwritten signature. It constitutes irrevocable acceptance of the T&Cs.

The contract is concluded only after the Seller emails an order registration confirmation. After the order is recorded, a detailed invoice printable by the Buyer will be sent by email. The Seller reserves the right to refuse delivery or honor an order if the Buyer has not fully or partially paid a previous order, or if a payment dispute remains.

3-3 – Order processing
From October 1 to April 30: any order placed before noon Monday to Friday (excluding public holidays) is prepared and shipped the same day or by the next day at the latest (excluding Saturdays and public holidays), provided all products are shown in stock and payment is validated. Orders placed over the weekend are processed on the next business day. Outside this period, up to 5 additional business days may apply. Saturday delivery is not guaranteed. Delivery times run from collection of parcels from our warehouse. Our logistics service operates Monday to Friday only.


ARTICLE 4: PAYMENT

The Seller offers various payment methods. Orders are payable in euros. The total price is due when ordering. The Buyer undertakes to pay the price of the item(s) ordered, including the item price and any shipping and processing fees. As part of combating online fraud, the Seller reserves the right to request a copy of ID and proof of address for any payment.

4-1 – Payment by bank card
Only the following cards are accepted: CB, Visa, Mastercard, Maestro, Visa Electron, e-Carte Bleue. The card is debited when the order is confirmed. The Buyer warrants they have any necessary authorization to use the card at the time of ordering. The Seller uses all necessary means to ensure the security and confidentiality of data transmitted on the Site during card payment, notably via the Banque Populaire secure payment platform.

4-2 – Payment by cheque (France only)
You may send a cheque or money order payable to MOJO TECHNOLOGIES to the address provided after contacting us at gestion@ski-mojo.fr. We will wait for your payment before shipping your order. The cheque must be drawn on a bank located in France. We reserve the right to request ID and proof of address to authenticate your payment.

4-3 – Payment by bank transfer
When you select bank transfer, our bank details (RIB) will be displayed. We will wait for your payment before preparing and shipping your order. Products are reserved upon receipt of the transfer. Delivery times run only from the date we actually receive your payment. Please include your order number with your transfer. The order will be validated only upon receipt of the full amount. International transfers must not be made with shared fees or fees charged to the recipient, as we would not receive the full amount due.

4-4 – Payment in 2 or more instalments by card (€50 to €1,200)
This offer is reserved for individuals (adult natural persons) residing in France and holding a Visa or MasterCard with an expiry date beyond the financing term selected. Other cards are not accepted. Subscription terms: after completing your order, simply click the “pay in 2 instalments by bank card” button. Processing/insurance fees may be added to your order amount and the instalment schedule will be clearly displayed on screen.

4-5 – Non-payment and retention of title
Products remain the property of the Seller until full and final payment of their price, including shipping and taxes. In case of non-payment, the Buyer must return the goods to the Seller at their own expense, failing which legal action may be taken. Any attempted fraudulent use of a payment method will also be prosecuted.


ARTICLE 5: DELIVERY

Products are delivered to the delivery address provided during the order process. In case of an address error, the Seller cannot be held responsible for any failed delivery; costs for a new delivery will be borne by the Buyer and invoiced at actual cost. The Seller undertakes to deliver the items ordered as quickly as possible, depending on the delivery method chosen and item availability. Delivery times shown on the Site are indicative average times and reflect total processing and transit time. If you order several products with different shipping times, the effective shipping time may be the longest one, as the order is prepared when all items are in stock. Delivery is deemed completed upon handover of the product to the Buyer. The delivery slip issued by the carrier is proof of transport and delivery.

5-1 – Checking parcel condition upon delivery

The Seller recommends that the Buyer check the contents, conformity and condition of the parcel(s) upon delivery and in the presence of the carrier.

  • Check the condition of the goods received and make precise, dated and signed handwritten reservations, and have the driver sign next to them.
  • Lodge any claim with the carrier by registered letter with acknowledgement of receipt within three (3) business days of receipt and send a copy to the Seller.


After this period, the product will be deemed accepted and free of apparent defects; the Buyer can no longer claim delivery error or apparent defect. Once the delivery note is signed by the Buyer or any authorized person, the parcel is deemed checked and no further dispute can be raised. The Seller’s liability cannot be engaged.

5-2 – Delivery delay
If a delivery delay occurs, or if parcels are lost by carriers, the Buyer must notify the Seller by email or phone within ten (10) days of receiving the order confirmation email. We will assist you with carrier procedures. For information, if an issue arises with a Colissimo shipment, investigations may be lengthy (up to one month).

5-3 – Delivery in case of absence
If the recipient is absent at delivery, the carrier will leave a notice at the delivery address provided by the Buyer. The order must be collected at the location and under the conditions indicated by the carrier. If not collected within the allotted time, the order will be returned to the Seller, who may choose to refund the price; shipping costs remain borne by the Buyer.


ARTICLE 6: RIGHT OF WITHDRAWAL

In accordance with applicable law, the Buyer may exercise the right of withdrawal once the order is validated and up to fourteen (14) days after delivery, without having to provide reasons or pay penalties.

To meet the withdrawal deadline, it is sufficient for the Buyer to send notice of exercising the right of withdrawal before the deadline expires, by email to gestion@ski-mojo.fr.

If the right of withdrawal is exercised within the above period, only the price of the product(s) purchased and the shipping fees* will be refunded to the customer (*up to a flat €10 in France and up to €20 outside France for outbound shipping). Direct return costs are borne by the Buyer.

The Seller will inform the Buyer by email or phone of the return or pickup procedure and the address to which the product(s) should be sent. If the product must be returned by the Buyer, it must be sent back at the Buyer’s expense without undue delay and in any event no later than fourteen (14) days after the Buyer has notified the decision to withdraw. The deadline is met if the Buyer dispatches the product before the fourteen (14) days expire.

The product must be returned under the conditions described below. The Buyer must enclose a copy of the purchase invoice and the withdrawal form (a template is provided in the Annex to these T&Cs).

Products that are dirty, damaged or incomplete will not be accepted, or may be accepted only with a deduction, which will be proposed to the Buyer wishing to exercise the right of withdrawal.

The Buyer may handle the product to establish its nature, characteristics and proper functioning. However, the Buyer may be held liable for any depreciation resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product.

The Buyer will be refunded no later than fourteen (14) days from the date the Seller receives the returned products at its premises and after their condition has been checked. Refunds will be made using the same payment method used by the Buyer for the purchase (e.g., by credit to the same bank card if that was used).

6-1 – Conditions for exercising the right of withdrawal
6-1-1 – Product condition

The product must be returned new, properly protected, in its original undamaged packaging, with all accessories, user manual and documentation supplied at purchase. Note: the delivered products must not have been used beyond what is necessary to assess their nature, characteristics and proper functioning. If you tested the Ski-Mojo, please remove any traces of use; otherwise we will charge a flat €85 for refurbishment and replacement of neoprene sleeves. No return will be accepted if the products have clearly been used or damaged by the Buyer in a way that makes them unfit for resale.

6-1-2 – Exclusions

The following items will not be taken back or exchanged:

  • Customized products or items made to the Buyer’s specifications.
  • For returns of a pack, the entire pack must be returned; partial returns are not allowed.
  • Returns may be refused for certain undergarments such as boxer shorts.


For any Personal Protective Equipment (helmet, harness, carabiner, climbing belt, etc.), our teams pay particular attention to the condition of returned products: they must not have been worn, and tags, protective films and packaging must not have been removed, failing which the return will be refused.

6-1-3 – Return procedure

The Buyer bears the cost of returning the product. The Buyer must contact Mojo Technologies Customer Service by email at gestion@ski-mojo.fr. We will email you a return slip to include in your parcel.

Returns are under the Buyer’s sole responsibility; any risk (damage, theft, breakage) remains with the Buyer. The Seller cannot be held responsible for customs duties you may have to pay upon return and reshipment. Freight collect returns will not be accepted. Upon receipt of your return, we verify its conformity. No return will be accepted if the products have clearly been used or damaged by the Buyer making them unfit for sale. If your return cannot be accepted, we will contact you to send the products back to you at your expense.

6-1-4 – Processing the return

The Seller will refund the Buyer from the date it is informed of the withdrawal decision and may defer the refund until the goods are recovered or until the Buyer provides proof of dispatch of the goods. The refund will be made to the billing address recorded at the time of order and via the same payment method used for payment.

6-2 – Extended right of withdrawal

The Seller offers the Buyer the option to exercise the right of withdrawal beyond the statutory fourteen (14) days under the following conditions:

  • The conditions for this Extended Right of Withdrawal are the same as those applicable within the 14-day statutory period.
  • However, the original outbound shipping fees paid by the Buyer will not be refunded. In addition, a flat deduction will be applied to the amount refunded for returned products:
    • 10% if exercised between days 15 and 29 from the date the products were received by the Buyer;
    • 22.5% if exercised between days 30 and 45;
    • 40% if exercised between days 46 and 60;
    • No withdrawal is accepted after 60 days from the date of receipt.


ARTICLE 7: AFTER-SALES / WARRANTIES

7-1 – Statutory warranties
All our products automatically benefit from the statutory warranties applicable in your country of residence. These rights apply independently of any commercial warranty offered by Mojo Technologies and cannot be limited by these T&Cs. In practice, if a product has a manufacturing defect or does not conform to what was agreed at sale, you may request repair, replacement, or—if that is not possible—a partial or full refund.

7-2 – Mojo Technologies commercial warranty

In addition to statutory warranties, Mojo Technologies offers a warranty covering defects in materials or workmanship in the context of normal use of the product and in accordance with the User Manual.

If a defect is acknowledged, we may, as applicable:

  • repair the product,
  • replace it with an equivalent new or refurbished product,
  • or refund it (in whole or in part) where the two previous solutions are impossible or disproportionate.


In some cases, and where technically feasible, Mojo Technologies may decide to send the Buyer the parts needed for repair together with instructions, so that the Buyer can restore the product without returning it.

The choice of the most appropriate solution depends on the nature of the issue, parts availability and reasonable repair cost.

7-3 – Claim procedure
  1. Contact our customer service at gestion@ski-mojo.fr describing the issue and attaching at least one photo and your proof of purchase.
  2. We will send you a return form and instructions.
  3. The product must be returned clean, properly packaged, and accompanied by the after-sales (SAV) form and the invoice.
  4. After inspection, we will confirm coverage and the chosen solution (repair, exchange, shipment of spare parts, or refund).


The average processing time for an after-sales case is up to 3 weeks from receipt of the product.

7-4 – Warranty exclusions

The warranty does not cover:

  • abnormal use or use not in accordance with the User Manual,
  • impacts, drops, modifications or unauthorized repairs,
  • damage due to external causes (transport, improper storage, abnormal exposure, etc.),
  • wear parts such as: cables, boot connectors, tibial rods (except malfunction) and neoprene sleeves,
  • consequential or indirect damages such as injuries, loss of use, equipment downtime, rental or travel costs, or any other financial or material loss directly or indirectly related to use of the product.


Products that are incomplete, in poor condition or dirty may be refused, or a flat deduction may be applied before refund or exchange.

7-5 – Transport costs
  • Outbound shipping to Mojo Technologies is at the Buyer’s expense, including any import duties and taxes.
  • Return shipping after approved warranty service is covered by Mojo Technologies only if the delivery address is within the European Union.
  • For shipments outside the EU, fees may apply; a quote will be provided to the Buyer before the product is returned.


In some cases, to avoid costly or unnecessary returns, Mojo Technologies may prioritize sending spare parts to the Buyer to allow a direct repair.

7-6 – Conditions for validity

The commercial warranty applies only upon presentation of proof of purchase issued by Mojo Technologies or an authorized reseller. It is valid only in countries where the product is officially distributed and service can be provided.

Application of the warranty is subject to compliance with the procedure described in Article 7.3. In particular, the Buyer must:

  • contact customer service beforehand and obtain return instructions,
  • return the product properly protected, with the duly completed after-sales (SAV) form and the purchase invoice,
  • ensure the product is clean and suitable for inspection.


If these conditions are not met, Mojo Technologies may refuse warranty coverage.


ARTICLE 8: RETENTION OF TITLE

Products remain the property of the Seller until paid in full. Risk of loss or damage transfers to the Buyer upon physical handover of the product to the Buyer or a third party designated by the Buyer. If the Buyer entrusts delivery to a carrier of their own choosing (not offered by the Seller), risk transfers when the product is handed over to that carrier.


ARTICLE 9: PERSONAL DATA

Information requested by the Seller is necessary to manage the Buyer’s order (processing and delivery of orders, invoicing). Failure to provide such information may impair or prevent the provision of the requested service or product. The Seller ensures confidentiality and security in compliance with Regulation (EU) 2016/679 on data protection (“GDPR”) of 27 April 2016.

Depending on the Buyer’s choices when creating or modifying an account, the Buyer may receive information and commercial offers from the Seller and other companies. The Buyer may opt out at any time by sending a request via the contact form on the Site.

Buyer information, which may include personal data, may be transmitted to the Seller’s service providers and partners for payment processing, order delivery, Site security, compliance with legal and regulatory obligations, and to improve and personalize services offered to the Buyer on the Site.


ARTICLE 10: INTELLECTUAL PROPERTY

All text, photos, comments, works, illustrations and images reproduced on the Site are its property. Consequently, it is strictly forbidden to reproduce, download, copy or exploit them—even partially—for commercial purposes anywhere in the world without prior authorization from MOJO TECHNOLOGIES.


ARTICLE 11: LIABILITY

Products offered on the Site comply with French laws and standards in force. The Seller cannot be held liable for non-performance or improper performance of the contract in cases of force majeure, acts attributable to the Buyer, or any foreseeable and insurmountable inconvenience inherent to the use of the internet. The Seller will not be liable for any indirect damages arising from the purchase of products.

Photos, graphics and descriptions accompanying products are non-contractual and do not engage the Seller’s liability. As the Site is hosted by an external provider, the Seller cannot be held liable for interruptions of service, bugs, inaccuracies or omissions in information available on the Site, or for any damage resulting from fraudulent intrusion by a third party altering Site information. For all steps of accessing the Site, browsing, filling out forms, ordering, delivering items or other services, Mojo Technologies is only bound by a best-efforts obligation.

Accordingly, the Seller cannot be held liable for any inconveniences or damages inherent to internet use (loss of data, files, etc.) and entirely outside the diligence and precautions taken by the Seller. The Seller disclaims responsibility for the content of any sites to which hyperlinks from its own Site may lead, as it cannot control their content.


ARTICLE 12: ARCHIVING – EVIDENCE

The Seller will archive order forms and invoices on a reliable and durable medium constituting a true copy, for a retention period of 10 years. The Seller’s computerized records will be considered by the parties as proof of electronic communications, orders from the Buyer, confirmation emails sent by the Seller, the T&Cs applicable at the order date, and payments and transactions between the parties.


ARTICLE 13: GOVERNING LAW – DISPUTE RESOLUTION

These T&Cs are governed by and construed in accordance with French law. In the event of a dispute, the parties will seek an amicable solution before bringing any legal action, which must be filed with the competent French courts. Please contact our customer service by email at gestion@ski-mojo.fr or by phone at +33 (0)4 65 84 34 00. Our advisors are available Monday to Friday, 9:00–19:00 local French time (CET/CEST).

Consumers may use a consumer mediation service free of charge to seek an amicable resolution. Buyers may also use the European online dispute resolution (ODR) platform: https://ec.europa.eu/odr.


ARTICLE 14: LANGUAGE

These T&Cs are drafted in French. In the event of any discrepancy between different language versions, the French version shall prevail.


Annex – Withdrawal Form

Please complete and send this form to gestion@ski-mojo.fr (or call +33 (0)4 65 84 34 00 to obtain a postal address) only if you wish to withdraw from your order placed on the Site (products sold and shipped by Mojo Technologies)—subject to any exclusions or limits to the right of withdrawal under the applicable T&Cs.

Before using the Ski~Mojo: essential information for use (Terms of Use – pre-contractual summary)

This box summarizes the Ski~Mojo Terms of Use (ToU). It does not replace the User Manual or the full ToU. The most recent version of the Manual and ToU is available at www.ski-mojo.com/help. Using the product implies acceptance of the ToU.

Intended use

The Ski~Mojo is intended for skiing as described in the Manual. Jumps and acrobatic moves are excluded. The user must meet the stated requirements (e.g., minimum height, settings), assess their physical condition, and consult a health professional if in doubt.

Safety, installation and maintenance

  • Before first use: follow the First installation procedure.
  • Before each outing: perform a visual check (tibial rods, cables, boot connectors, neoprene sleeves, fastenings).
  • Follow the maintenance intervals recommended in the Manual.
  • Any unauthorized modification is prohibited and may void the warranty.

Warranty – summary

Commercial warranty of 2 years against defects in materials and/or workmanship, within normal use in accordance with the Manual. In the event of a confirmed defect, Mojo may, as applicable:

  • repair the product (refurbishment or component replacement),
  • replace the product with an equivalent new or refurbished unit,
  • or supply spare parts with instructions for user-performed repair where technically appropriate.


Key exclusions:
loss/theft, misuse, collision/fall, unauthorized modifications, improper storage, and normal wear (tibial rods, cables, boot connectors, neoprene sleeves).

Practical details (contact, proof of purchase, shipping costs): see Article 7 of the T&Cs above.

Liability – important limitations

  • Skiing involves inherent risks; following the Manual reduces but does not eliminate these risks. The user remains responsible for their manner of skiing, the suitability of the product to their person, and compliance with the ToU.
  • Mojo Technologies cannot be held liable, to the user or any third party, for damage or injury, direct or indirect, resulting from non-compliant use or from a malfunction occurring despite compliance with the ToU.
  • In any case, Mojo’s total cumulative liability is capped at the product’s purchase price and shall not exceed the list price before taxes, excluding shipping and handling.
  • The following are excluded from any compensation, among others: consequential or intangible losses (loss of use, equipment downtime, rental or travel costs, loss of income or profits, etc.).
  • Mojo disclaims all other warranties, express or implied, to the extent permitted by applicable law.
  • These limitations do not affect the consumer’s mandatory legal rights.

Hierarchy

The T&Cs govern purchase and delivery; the ToU govern use. In case of inconsistency, the most recent version of the Manual/ToU prevails for use-related matters.
